Irrelevant, unless the judge decides to completely dismiss the TRCA lawsuit...and it might just do that. If that's the case INSM flies and TRCS sinks.
In any case, I don't believe anything will be decided on 4/18/06. Even if a the judge decided on way for the other, either company has the right to appeal the decision and that can go on for a long time.
Now a bit of perspective in these lawsuits:
TRCA filed an "unfair business practices" lawsuit in California, claiming the INSM was saying bad things about Increlex and needed to be enjoined from doing so and pay damages to TRCA. INSM keeps getting that Complaint dismissed, and TRCA keeps amending their Complaint to add new or slightly different allegations. INSM has a Motion to Dismiss the latest reincarnation of the Complaint set for hearing on April 18. IMHO, the likely result will be another Amended Complaint by TRCA after the Judge rules for INSM, meaning that the lawsuit will continue. One problem TRCA has is that INSM has never mentioned Increlex by name in any of its presentations touting iPlex, and their is a chance the Judge might just throw the suit out permanently absent some evidence that INSM has defamed Increlex by name rather than by innuendo. IMHO, the Judge will leave the innuendo issue for a jury to decide, but I've been wrong before.
Besides the above, there are two more lawsuits.
First, there is a patent lawsuit in England. It is hard to get info on that one. To the best of my knowledge, no important dates are pending.
Second, there is a patent suit in the US, out in California. There is a claim construction hearing scheduled in May. If you do anything this weekend to help yourself understand your investment in INSM, go read this article:
