    Nog ff en dan door de 15€. Voorraden moet naar beneden, olie productie moet omlaag, koers SBM omhoog ha, ha, ha,.

    Verdere stijging olie prijs vandaag. Gaat giga hard omhoog, koers SBM boven de 15€ eind van het jaar, zeker als er verder positief nieuws komt of tenders.

    Tegen de tijd dat het verandert, zal de impact...nauwelijks waarde hebben nog.

    Maar die gedachte...brengt een heleboel rust en kalmte :)

    Laten wij het daarop houden, uiteindelijk kunnen zij in Brazilië niet zonder SBM, mogelijk krijgt SBM geld toe. Beter gein dan zorgen maken.

    De deal bracht een schokgolf teweeg omdat 200 congresleden nu in verband gebracht kunnen worden met het omkoop-onderzoek "Carwash" ;

    Prosecutor rejects AGU claims on leniency deals

    Deputy Prosecutor General of the Republic, Marcelo Muscogliati, rejected claims of the Federal Attorney General (AGU), Grace Mendonça, who told Valor Tuesday that signing leniency deals with a single government body creates legal insecurity for the company that signs them. Ms. Mendonça was discussing the Brazilian Development Bank's decision to continue holding back loans from companies investigated by Operation Car Wash which signed leniency deals with the Federal Public Ministry (MPF).

    “I disagree with that opinion because there is no legal insecurity. What Minister Grace said is her point of view, according to her role at the AGU. The Public Ministry isn't the exclusive plaintiff of improbity cases or any other case. Each body can propose a lawsuit within its jurisdictional scope,” Mr. Muscogliati said,

    Mr. Muscogliati leads the 5th Chamber of Coordination and Revision (CCR) of the MPF, which is working on cases involving improbity or crimes committed by public servants against the government. Before being forwarded to the judiciary for certification, the leniency and informant deals must be approved by the CCR.

    The Deputy Prosecutor General said the MPF doesn't focus mainly on repairing the damage to public finances when it negotiates leniency deals with companies, contrary to what happens at the AGU.

    “For us, the main goal is to ensure the activity of a criminal organization is stopped. This disorganization of illegal acts practiced by a company is the central issue for the Public Ministry. Repairing the damages comes in second,” he said.

    Mr. Muscogliati said companies such as those investigated by Car Wash seek deals with the MPF because their actions could have criminal and civil law consequences. “When there is this expectation of criminal consequences, the company reaches an agreement in the administrative sphere with the Cade [Administrative Council for Economic Defense, linked to the Ministry of Justice]. Several companies made deals just with Cade,” he said.

    But the Deputy Prosecutor General avoids clashing with Ms. Mendonça when asked about the fact the MPF is fighting with other bodies regarding who can sign leniency deals. “It's an old discussion, but I don't see it as a power struggle. What happens is an issue of legislative interpretation,” he said

    Behind the scenes, some investigators working with Operation Car wash consider the “alleged” legal insecurity of companies investigated for corruption is caused by the fact that the Anti-Corruption law increased too much the number of government bodies that can sign leniency deals.

    “We cannot accept that companies who admitted crimes can shop around government bodies in search of the best deal for them. It seems surreal to me,” one of the investigators, who requested to remain anonymous, says.

    De discussie (lees: chaos) in Brazilië rond leniency-overeenkomsten is dus nog lang niet verleden tijd en het lijkt me dat SBM Offshore alleen maar lijdzaam kan toekijken.
    Het maakt me niet optimistisch voor de Libra-tender.

    Inderdaad: een land in chaos. Ik durf geen voorspellingen te doen.

    Aan de andere kant zakt Brazilië steeds dieper in recessie. Enig pragmatisme zou niet misplaatst zijn. Dat is uiteraard te veel gevraagd; ego's gaan boven het landsbelang.
